Terms and Conditions

GENERAL
Art. 1
These general terms and conditions apply to every purchase-sale agreement concluded by a visitor to this website, hereinafter referred to as “customer”, with RIMBIT – YPRESS DIGITAL MUSIC EDITIONS, Brugseweg 117 8900 Ieper – BE0855.552.272.
These general terms and conditions always take precedence over any other terms and conditions of the customer. Additional terms and conditions of the customer are excluded, unless they have been expressly accepted by us in writing and in advance.

ORDER
Art. 2
An agreement is validly concluded when the order is submitted electronically by clicking on the hyperlink “Agree to this order”, or by sending an email containing an order.

LIABILITY
Art. 3
Although our goods are carefully edited by us, it is possible that, due to the nature of the product, a product you purchase does not fully meet your needs or is not specifically adapted to your situation. In this case, we disclaim any liability to ourselves and would like to point out that you are solely responsible for the use of these products.

RIGHT OF REJECTION
Art. 4
Given the nature of the goods sold, it follows that they cannot be returned, so that you can do so in accordance with art. 80 §4, 2° Act on Commercial Practices and Consumer Information does not have a right of renunciation. Every purchase-sale is final from the conclusion of the agreement and not subject to any reflection period. The consumer does not have the right to cancel the purchase.

PAYMENT
Art. 5
Payment is always made electronically via payment card or bank transfer. Each order is immediately payable at the time of concluding the agreement. When paying by bank transfer, you will only receive the ordered goods in the form of a download link after receipt of the amount due.

PERFORMANCE
Art. 6
The execution of the agreement normally takes place almost immediately after payment by credit card or confirmation of payment by bank transfer or Paypal. However, any delay in implementation does not give the right to compensation in any case. In case of payment by bank transfer, delivery of the ordered products will take place within five working days after our account has been credited. In this case too, any delay in implementation does not give the right to compensation.

DISPUTES
Art. 7
All disputes arising from this agreement are governed by Belgian law. The Court of the District of Ypres (Belgium) has jurisdiction for all disputes arising from this agreement.

BINDING
Art. 8
With every electronic order for products, the customer expressly agrees to these general terms and conditions by checking the “Agree” checkbox. An electronic order without this statement of agreement is, barring fraud, technically impossible, so that these conditions are always binding on the customer.

COPYRIGHT

We apply the following rules for reproduction rights:
General:
– Ypress Digital Music Editions gives customers permission to print out copyrighted material for use and study in class or with orchestra.
– Only the customer of Ypress Digital Music Editions may use these copyrighted materials. Passing on to third parties is prohibited at all times.
– As proof of this, you can always ask for the accompanying invoice, in the name of the customer, company or association.

Part-time art education:
– After purchase, teachers can copy copyrighted material indefinitely for use during lessons for their own students in 1 educational institution.
– If the student performs the copyrighted material publicly (e.g. a concert), the student must purchase his or her own copy of the copyrighted material.
– Teachers may not distribute copyrighted material among themselves. The purchase remains personal and is not transferable.

Orchestras/Associations:
– Every orchestra that purchases copyrighted material from Ypress Digital Music Editions must have a purchase invoice as proof of public use. 
– Orchestras/Associations are not given permission to distribute copyrighted material. The purchase remains in the personal capacity of the association and is not transferable.
